Supreme Court to Hear Case on Including Judges in Asset Investigation

Kathmandu. A writ petition filed stating that judges and former judges are also included in asset investigation has been scheduled for hearing. The writ petition filed by advocate Dr. Premraj Silwal has been scheduled for hearing in the joint bench of Chief Justice Dr. Manojkumar Sharma and Justice Tekprasad Dhungana.

Advocate Silwal has filed the writ petition claiming that the Asset Commission is unconstitutional and beyond its jurisdiction. The writ has been filed stating that if there is any basis and evidence of corruption by the Chief Justice or a judge, then according to the legal provisions and legal process, as per Article 101 of the Constitution, after being removed from office through impeachment by the Parliament, the investigation, inquiry, and prosecution can be carried out by the constitutional body, the Commission for Investigation of Abuse of Authority, and a case can be filed in the Special Court. The writ argues that the provision related to the commission's jurisdiction is contrary to this constitutional arrangement.
