Pratappur Rural Municipality Chairman Umeshchandra Yadav's Arrest Cleared by High Court

Butwal. The way has been opened to arrest Umeshchandra Yadav, chairman of Pratappur Rural Municipality in West Nawalparasi. The police have been legally cleared to arrest him after the High Court, Tulsipur, Butwal bench, did not extend the interim order it had previously issued regarding Yadav. The joint bench of judges Milan Kumar Rai and Omprasad Aryal issued the order. Yadav had filed a writ petition in the High Court seeking to quash the arrest warrant issued against him and to prevent his arrest, naming the Area Police Office, Belatari, and other respondents. After hearing the writ, the court studied the written response submitted by the respondent police office and the attached documents. It appears that the police conducted preliminary investigations before seeking permission to arrest Yadav, as per the court's order. The permission to arrest Yadav was sought based on the written response and documents sent by the Area Police Office, Belatari, to the District Police Office, Nawalparasi. The court order states that the Nawalparasi District Court granted permission to arrest Yadav on Shrawan 20. After obtaining the arrest permission from the district court, Yadav had filed a writ in the High Court seeking to prevent his arrest. The High Court had previously issued an interim order, instructing not to arrest him immediately. Senior advocate Dhanjeev Sharma and advocates Govindasingh Thapa, Mahendraprasad Pandey, Shraddha Suman Acharya, and Sanjita Poudel argued on behalf of Yadav in this case. Deputy Attorney General Himānanda Gautam of the High Government Attorney Office, Butwal, argued on behalf of the respondent police office, and advocate Nasarullah Ansari argued on behalf of the respondent Somitkumar Haluwai. With the court not extending the interim order, the legal path has been opened for the police. An investigation was initiated by the police to arrest Yadav due to a complaint filed against him regarding the creation of fake documents for government land. The police can now arrest him based on the arrest permission obtained from the district court.
