Fact Check: Ashika Tamang’s Claim That Nepal’s Law Treats Marital Rape and Minor Rape Equally Is False

Kathmandu. Rastriya Swatantra Party (RSP) Member of Parliament Ashika Tamang has claimed that Nepal’s existing law does not classify punishment according to the nature of rape. She argued that the law treats the rape of a three-year-old girl and marital rape on the same scale and called for immediate legal reform.

However, an investigation by the TechPana FactCheck Desk has found the claim to be false. Chapter 18 of the Muluki Criminal Code of the victim. The punishment prescribed for rape of a girl below 10 years of age is substantially different from that prescribed for marital rape.
